Acceptance of terms
These Terms of Service (“Terms”) are a legal agreement between you and Build Fleet AIQ, the seller and operator of the Build Fleet AIQ platform (“we”, “us”, or “our”). By creating an account, accessing or continuing to use the platform, you agree to be bound by these Terms. If you do not agree, do not use the service.
Eligibility / account registration
You must be at least 18 years old and have the legal capacity to enter into these Terms. If you use the platform on behalf of a business, you represent that you are authorized to bind that business. You agree to provide accurate, current and complete information during registration and to keep it updated.
User responsibilities
You are responsible for:
- maintaining the confidentiality of your account credentials;
- all activity that occurs under your account;
- the accuracy and legality of the data, documents and content you upload or enter;
- complying with all applicable laws, regulations and industry requirements;
- obtaining any necessary consents from drivers, employees or other individuals whose data you upload.
Subscription plans
Build Fleet AIQ offers recurring monthly subscription plans: BUILD at $49/month, OPERATE at $79/month and GROW at $139/month. Features and limits vary by plan. Plan details and pricing are shown on the Pricing page and may be updated from time to time.
Free trial
New subscriptions may include a 14-day free trial when applicable. No payment is required during the trial. If you do not cancel before the trial ends, your selected payment method will be charged the applicable monthly fee beginning on the billing-start date.
Billing and renewals
Subscriptions automatically renew monthly unless cancelled. You authorize our payment provider to charge the applicable fee to your selected payment method. Billing is handled by Paddle as our Merchant of Record. You are responsible for keeping your payment information current.
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation and refund mechanics are also subject to Paddle's Buyer Terms.
Cancellation
You may cancel your subscription at any time through the Billing & Subscription settings in your account or by contacting our support team. Cancellation stops future renewals. Access may continue through the end of your current paid period where applicable.
Refunds
We offer a 30-day money-back guarantee for eligible purchases. Refund requests are handled according to applicable law, Paddle's rules and the Build Fleet AIQ Refund & Cancellation Policy. Please review our Refund & Cancellation Policy for details.
Authorized users
Depending on your plan, you may invite drivers, dispatchers or other team members as authorized users. You are responsible for their activity and for ensuring they use the platform in compliance with these Terms.
Business data
You retain ownership of the business data, documents and other content you upload or create in the platform. You grant us a limited licence to host, process, back up and display that content solely to provide the service to you.
AI Assistant
The Build Fleet AIQ AI Assistant provides decision-support information based on the data and context you provide. AI recommendations are not guaranteed facts and should not be treated as professional legal, tax, regulatory or financial advice. You are solely responsible for reviewing, verifying and acting on any AI output.
Voice AI
Voice features may process audio and generate transcripts to deliver spoken assistance. Voice interactions are subject to the same disclaimers as other AI features. You should not use voice features in situations where distracted operation could create safety risks.
Load and profitability estimates
Load ratings, profit estimates, cost-per-mile calculations and other projections shown in the platform are based on the data you enter and are provided for planning purposes only. Build Fleet AIQ does not guarantee load availability, broker payment, actual profitability or any specific business outcome.
Funding, grant and loan discovery
The platform may identify funding, grant, loan or business-development opportunities that may be relevant to your business. We do not guarantee grant awards, loan approval, funding approval, contract awards or any financial result.
Regulatory / compliance information
Build Fleet AIQ may organize compliance-related information and tasks, but it does not guarantee regulatory compliance, government certification or that any specific requirement is met. Users remain responsible for verifying official regulatory requirements and maintaining their own compliance programs.
ELD and telematics integrations
If you connect an ELD or telematics service, data is shared according to the permissions you grant and the terms of that third-party provider. Build Fleet AIQ is not a certified ELD provider unless separately qualified in writing, and users remain responsible for compliance with hours-of-service and other applicable regulations.
Third-party services
The platform integrates with third-party services such as payment providers, ELD systems and telematics platforms. Your use of those services is governed by their terms and privacy policies. We are not responsible for the availability, accuracy or practices of third-party services.
Intellectual property
Build Fleet AIQ owns all rights, title and interest in the platform, including software, designs, branding, documentation and content we create. You are granted a limited, non-exclusive, non-transferable, revocable licence to use the platform during your subscription term, subject to these Terms and your plan limits.
Acceptable use
You agree not to:
- use the platform for any unlawful purpose;
- upload or transmit harmful, infringing, fraudulent or misleading content;
- attempt to gain unauthorized access to the platform or other users' accounts;
- reverse engineer, scrape, probe or interfere with the platform's security or operation;
- resell, redistribute or sublicense access without our written consent;
- use the platform in any way that could create safety risks for drivers or the public.
Account suspension / termination
We may suspend or terminate your account if you materially breach these Terms, fail to pay amounts due, create a security or fraud risk, or repeatedly violate our policies. You may terminate your account at any time through your account settings. Upon termination, your right to use the platform ceases and we may delete your data in accordance with our Privacy Policy and applicable law.
Disclaimers
Build Fleet AIQ provides business-management and decision-support technology. It does not guarantee load availability, load profitability, broker payment, regulatory compliance, government certification, grant awards, loan approval, funding approval, contract awards, financial results or business success.
Build Fleet AIQ is not a law firm, accounting firm, lender, government agency, certified ELD provider (unless separately qualified) or financial adviser. The platform is provided on an “as is” and “as available” basis without warranties of any kind, express or implied, to the fullest extent permitted by law.
Limitation of liability
To the fullest extent permitted by law, our aggregate liability arising out of or relating to these Terms or the platform will not exceed the total amount you paid to us in the twelve months preceding the event giving rise to liability. We will not be liable for indirect, incidental, special, consequential or punitive damages, including lost profits, lost data or business interruption. Nothing in these Terms limits liability for fraud, death or personal injury where required by law.
Indemnification
You agree to indemnify and hold harmless Build Fleet AIQ and its operators, officers, directors, employees and agents from claims, damages, losses and expenses arising out of your content, your use of the platform, your violation of these Terms, or your infringement of any third-party right.
Changes to service
We may modify, suspend or discontinue any part of the platform at any time. We will use reasonable efforts to notify users of material changes that affect their subscriptions.
Changes to terms
We may update these Terms from time to time. We will post the updated Terms with a new “Last Updated” date. Continued use of the platform after changes become effective constitutes acceptance of the revised Terms.
